We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”) and other applicable South African laws. The information we collect depends on how you interact with NoSweat.

3.1 Candidates and talent

We may collect:

  • full name;

  • email address;

  • telephone and WhatsApp number;

  • location;

  • CV or résumé;

  • employment history;

  • qualifications and education;

  • professional skills;

  • experience level;

  • portfolio, website or LinkedIn profile;

  • salary expectations;

  • freelance rates;

  • availability;

  • preferred type of work;

  • job applications;

  • interview and placement information;

  • correspondence with NoSweat;

  • information contained in documents voluntarily provided to us;

  • identification information where required for verification or contracting;

  • banking and payment information where required for payment;

  • tax-related information where required;

  • information required for background or qualification verification; and

  • other information you choose to include in your NoSweat profile or application.

The current NoSweat candidate process asks applicants for information including their name, contact details, discipline, experience, rates or salary expectations, portfolio or LinkedIn URL and information about their work. (nosweat.co.za)

3.2 Clients and prospective clients

We may collect:

  • contact name;

  • company name;

  • email address;

  • telephone number;

  • job title;

  • billing and business information;

  • hiring requirements;

  • job descriptions;

  • salary or project budgets;

  • correspondence;

  • contracts;

  • invoices and payment records; and

  • information regarding candidates you interview, select or engage.

3.3 Freelancers and contractors

Where NoSweat facilitates an engagement, we may also process information required to:

  • prepare purchase orders or agreements;

  • administer the engagement;

  • process payments;

  • make applicable statutory deductions;

  • maintain accounting and tax records; and

  • manage client and contractor communications.

NoSweat's current candidate information states that, for applicable freelance work, NoSweat handles payment and PAYE deductions paid to SARS. (nosweat.co.za)

3.4 Website visitors

When you use our website, we may automatically receive information including:

  • IP address;

  • device and browser information;

  • pages visited;

  • date and time of visits;

  • login information;

  • website interactions; and

  • cookie and analytics information.

4. How We Collect Personal Information

We may collect personal information:

  • directly from you when you register, submit a form, upload a CV, create a profile or contact us;

  • when you apply for a position through NoSweat;

  • when a client submits a vacancy or hiring requirement;

  • during interviews, placement and contracting processes;

  • through correspondence by email, telephone, WhatsApp or other communication channels;

  • from publicly available professional sources such as company websites, portfolios or professional profiles where lawful and relevant;

  • from referees or verification providers where appropriate and lawful;

  • from clients or other parties involved in a placement; and

  • automatically through our website and related technologies.

Where we obtain information from another source, we will process it only where permitted by applicable law.



5. Why We Process Personal Information

We may process personal information to:

Candidates

  • create and maintain candidate profiles;

  • match candidates with suitable opportunities;

  • enable candidates to apply for jobs;

  • assess skills and suitability against job requirements;

  • present relevant candidate information to potential clients;

  • arrange interviews;

  • communicate regarding applications and opportunities;

  • facilitate freelance, fractional and permanent engagements;

  • verify information where necessary;

  • prepare contracts and purchase orders;

  • administer payments and statutory deductions;

  • maintain records of placements and work history; and

  • improve our matching and platform services.

Clients

  • create and maintain client accounts;

  • receive and manage job requirements;

  • source and match suitable talent;

  • provide candidate profiles and applications;

  • facilitate interviews and placements;

  • administer contracts and placements;

  • invoice and receive payment;

  • provide customer support; and

  • maintain business records.

General business purposes

We may also process information to:

  • operate and secure our website and systems;

  • prevent fraud or misuse;

  • meet accounting, tax, employment and other legal obligations;

  • respond to enquiries or complaints;

  • enforce agreements;

  • establish or defend legal rights;

  • improve our services;

6. Candidate Information Shared With Clients

A core purpose of NoSweat is to connect candidates with organisations looking for talent.

When you apply for a role or participate in our talent pool, relevant information from your profile or application may therefore be made available to or shared with prospective clients for legitimate hiring and selection purposes.

This may include:

  • your name;

  • CV;

  • portfolio;

  • professional experience;

  • qualifications;

  • skills;

  • availability;

  • salary or rate expectations; and

  • other information relevant to the particular opportunity.

We will not knowingly provide personal information to a client for purposes unrelated to hiring, contracting or the services provided by NoSweat.

Candidates should therefore avoid including unnecessary sensitive or private information in a CV or portfolio.



7. Background and Verification Checks

For certain placements, particularly permanent employment, NoSweat may facilitate or conduct verification checks where necessary, appropriate and legally permitted.

These may include:

  • identity verification;

  • qualification verification;

  • employment or reference checks; and

  • criminal-record checks where applicable and lawful.

Where consent, notification or another legal requirement applies to a particular verification process, we will follow the applicable requirements before processing the information.



8. Special Personal Information

We generally do not request special personal information unless it is necessary for a legitimate and lawful purpose.

Special personal information may include information regarding matters such as:

  • health;

  • biometric information;

  • race or ethnic origin;

  • religious or philosophical beliefs;

  • trade-union membership;

  • political persuasion;

  • sexual life; or

  • criminal behaviour.

Where NoSweat is required to process special personal information, we will do so only where POPIA or another applicable law permits us to do so and appropriate safeguards are in place.



9. How We Use Artificial Intelligence

NoSweat may use automated technologies, software or artificial-intelligence tools to assist with administrative, matching, search, summarisation, workflow or operational functions.

Where such tools are used, they may process information relevant to the task being performed.

We do not intend AI tools to make legally significant employment decisions about candidates without appropriate human involvement. The ultimate decision whether to interview, engage or employ a candidate is made by the relevant client.

Where appropriate, we use reasonable safeguards intended to restrict access to personal information and prevent its use for unrelated purposes.

Note: I recommend keeping this section if NoSweat is using Zoho AI, AI agents or other AI tools with candidate information.



10. Legal Grounds for Processing

Depending on the circumstances, we process personal information where:

  • you have consented to the processing;

  • processing is necessary to perform a contract with you or take steps requested by you before entering a contract;

  • processing is required by law;

  • processing protects a legitimate interest of the data subject;

  • processing is necessary for the legitimate interests of NoSweat or a third party, subject to your rights and applicable law; or

  • another lawful ground under POPIA applies.



11. Who We May Share Information With

Where reasonably necessary for the purposes described in this policy, we may disclose personal information to:

  • prospective and existing clients;

  • candidates and contractors where required to administer an engagement;

  • website, cloud-hosting and IT providers;

  • CRM and business-software providers;

  • communications providers;

  • accounting and payment-service providers;

  • banks;

  • payroll or tax-service providers;

  • background-screening and verification providers;

  • professional advisers, including accountants and legal advisers;

  • insurers;

  • governmental authorities including SARS where legally required;

  • the Information Regulator;

  • courts or law-enforcement authorities where lawfully required; and

  • other service providers acting on our behalf.

Our service providers may process personal information only for the purposes for which they have been engaged and subject to applicable contractual and legal obligations.

We do not sell personal information.



12. International Transfers

Some of the technology and cloud-service providers used by NoSweat may operate or store information outside South Africa.

Where personal information is transferred outside South Africa, we will take reasonable steps to ensure that the transfer complies with POPIA, including by using recipients or contractual arrangements that provide an appropriate level of protection where required.



13. Data Security

We take reasonable technical and organisational measures to protect personal information against:

  • loss;

  • unauthorised access;

  • unlawful processing;

  • destruction;

  • alteration; or

  • unauthorised disclosure.

Access to personal information is restricted to persons and service providers who reasonably require access for legitimate business purposes.

However, no electronic storage or internet transmission system can be guaranteed to be completely secure.

If a security compromise involving personal information occurs, NoSweat will take the steps required under POPIA, including notification to the Information Regulator and affected data subjects where required. Current Information Regulator guidance requires security compromises to be notified as soon as reasonably practicable and states that POPIA does not apply a minimum risk threshold for reporting. 14. How Long We Keep Personal Information

We retain personal information only for as long as reasonably necessary for:

  • the purposes for which it was collected;

  • maintaining candidate and client relationships;

  • providing placement and platform services;

  • complying with legal, accounting, tax or regulatory requirements;

  • resolving disputes; and

  • enforcing agreements.

Different categories of information may have different retention periods.

For example, certain financial and accounting records may be retained for the period required by applicable law.

When personal information is no longer reasonably required, we will delete, destroy, anonymise or de-identify it where appropriate.



15. Your Rights

Subject to POPIA and other applicable laws, you may have the right to:

  • ask whether we hold personal information about you;

  • request access to your personal information;

  • request correction of inaccurate or incomplete information;

  • request deletion or destruction of personal information where legally appropriate;

  • object to certain processing;

  • withdraw consent where processing is based on consent;

  • object to direct marketing;

  • lodge a complaint regarding our handling of personal information; and

  • lodge a complaint with the Information Regulator.

NoSweat's services are primarily intended for working professionals and organisations.

We do not knowingly collect personal information from children where doing so would require parental or guardian consent unless the necessary lawful authority has been obtained.
