At NoSweat, we take the protection of personal information seriously.
We collect and process personal information in order to operate our talent platform, connect candidates with suitable work opportunities, assist clients looking for talent, administer placements and fulfil our legal and business obligations.
We are committed to processing personal information responsibly and in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA").
POPIA establishes minimum requirements for the lawful processing of personal information by public and private organisations and gives individuals rights in relation to their personal information. (Government of South Africa)

Depending on how you interact with NoSweat, this may include information such as:

portfolio or professional profile;
freelance rates;
salary expectations;

job applications;
interview and placement information;

People who create profiles, join our talent pool, apply for freelance, fractional or permanent opportunities, or work through the NoSweat platform.
Clients
Businesses and representatives who post jobs, engage talent or use NoSweat’s services.
Freelancers and Contractors
Professionals engaged on assignments facilitated through NoSweat.
Suppliers and Service Providers
Businesses and individuals who provide services to NoSweat.
Website Visitors
People who visit or interact with www.nosweat.co.za.
Other Business Contacts
People who communicate or transact with NoSweat in a professional capacity.
4. Why We Collect Personal Information
We process personal information only where there is an appropriate purpose and lawful basis for doing so.
Depending on your relationship with NoSweat, we may use information to:
create and maintain candidate profiles;
operate candidate and client accounts;
allow candidates to apply for opportunities;
match candidates with suitable client requirements;
assess professional skills and experience;
prepare candidate profiles and shortlists;
present relevant candidates to prospective clients;
arrange interviews;
communicate about opportunities and applications;
facilitate freelance, fractional and permanent placements;
administer contracts and purchase orders;
process freelancer payments;
administer applicable tax obligations;
invoice clients and maintain accounting records;
verify information supplied by candidates;
perform legally permissible background or qualification checks;
provide customer and candidate support;
secure and operate our website and systems;
prevent fraud or misuse;
maintain appropriate business records;
comply with legal and regulatory requirements; and
establish, exercise or defend legal rights.
NoSweat currently operates a platform through which clients post requirements and candidates create profiles and apply directly for work. For freelance engagements, NoSweat also handles payments and applicable PAYE administration. (No Sweat)
5. Candidate Information and Clients
A core part of NoSweat’s service is connecting talent with businesses looking for people with relevant skills and experience.
If you apply for a position or participate in the NoSweat talent pool, information relevant to an employment or freelance opportunity may therefore be shared with prospective clients.
Depending on the opportunity, this may include:
your name;
CV;
portfolio;
skills;
employment history;
qualifications;
professional experience;
availability;
rate or salary expectations; and
other information relevant to the role.
Clients review candidates and make their own hiring or engagement decisions. NoSweat facilitates the platform, matching and related administration. The current website allows clients to review matched candidates and select whom they wish to hire. (No Sweat)
We encourage candidates not to include unnecessary sensitive personal information in their CVs or portfolios.
6. Background and Verification Checks
For certain placements, NoSweat may perform or facilitate appropriate verification checks.
These may include:
identity verification;
employment or experience verification;
qualification verification;
reference checks; and
criminal-record checks where lawful and appropriate.
NoSweat’s current client service states that ID, qualification and criminal-record checks may form part of full-time placement vetting. (No Sweat)
Information relating to criminal behaviour may receive additional protection under POPIA. Where such information is processed, NoSweat will do so only to the extent permitted by law and subject to any consent, safeguards or regulatory authorisation that may be required.
The Information Regulator identifies the processing of information concerning criminal behaviour or unlawful conduct on behalf of third parties as one of the circumstances in which prior authorisation may be required under section 57 of POPIA. (eservices.inforegulator.org.za)
7. Special Personal Information
POPIA places additional restrictions on certain categories of particularly sensitive information.
Where relevant to our services and legally permitted, this may include information concerning matters such as:
health;
biometric information;
race or ethnic origin;
religious or philosophical beliefs;
political persuasion;
trade-union membership;
sex life; or
criminal behaviour.
NoSweat does not require candidates to include unnecessary special personal information in their ordinary candidate profiles.
Where special personal information is genuinely required, we will process it only where permitted under POPIA and with appropriate safeguards.
8. How We Obtain Personal Information
We generally obtain personal information:
directly from you;
when you create an account or profile;
when you upload a CV or portfolio;
when you submit a job application;
when a client submits a job requirement;
through emails, telephone calls, WhatsApp or other communications;
during interviews, placements and contracting processes;
from referees or verification providers where appropriate;
from clients involved in a placement;
from professional or publicly available sources where lawful and relevant; and
automatically through our website and associated technology.
9. Who May Receive Personal Information?
Where necessary for legitimate NoSweat activities, information may be provided to or processed by:
prospective or existing clients;
candidates and contractors where necessary for an engagement;
technology and cloud-service providers;
CRM and business-software providers;
website and hosting providers;
communications providers;
payment and banking providers;
accounting, payroll and tax-service providers;
background-screening and verification providers;
professional advisers;
accountants and auditors;
legal advisers;
SARS and other governmental authorities;
courts or law-enforcement bodies where legally required;
the Information Regulator; and
other service providers acting on our behalf.
We expect service providers processing personal information on our behalf to use appropriate confidentiality, security and data-protection measures.
10. International Transfers
Some of the technology and cloud services used by modern online businesses may store or process information outside South Africa.
Where NoSweat transfers personal information outside South Africa, we will take reasonable steps to ensure that the transfer complies with the cross-border requirements of POPIA.

11. How Long Do We Keep Information?
We do not intend to keep personal information indefinitely.
Information will be retained for as long as reasonably necessary to:
provide our services;
maintain an active candidate or client relationship;
administer applications or placements;
maintain contracts and transaction records;
comply with tax, accounting and other legal requirements;
resolve disputes;
deal with claims; and
protect legitimate business interests.
Different categories of records may therefore have different retention periods.
When information no longer needs to be retained, it may be securely deleted, destroyed, anonymised or de-identified, subject to applicable legal requirements.
12. Keeping Your Information Secure
NoSweat takes reasonable technical and organisational steps designed to protect personal information against:
loss;
unauthorised access;
unlawful processing;
destruction;
alteration; and
unauthorised disclosure.
Depending on the systems involved, measures may include access controls, passwords and authentication, reputable technology providers, system security, backups and restricting access to people who require the information for legitimate purposes.
POPIA requires responsible parties to establish appropriate safeguards to protect the integrity and confidentiality of personal information. (Government of South Africa)
No electronic system can, however, be guaranteed to be completely immune from security incidents.
13. What Happens if There Is a Data Breach?
A compromise involving personal information may include accidental loss, unauthorised access, unlawful disclosure or a cybersecurity incident.
If a security compromise affecting personal information occurs, NoSweat will investigate the incident, take appropriate steps to contain and mitigate it and make the notifications required under POPIA.
Current Information Regulator guidance states that the responsible party must notify both the Regulator and affected data subjects as soon as reasonably possible, subject to the provisions of POPIA. The Regulator also states that POPIA does not impose a minimum risk threshold below which security compromises can simply be ignored for reporting purposes. (Empowered Compliance Monitoring)

14. Your Rights Under POPIA
Subject to applicable law, you may have the right to:
ask whether NoSweat holds personal information about you;
request access to personal information held about you;
request correction of inaccurate or incomplete information;
request deletion or destruction where NoSweat is no longer authorised to retain the information;
object to certain processing;
withdraw consent where processing depends upon your consent;
object to certain direct marketing;
complain to NoSweat about the processing of your information; and
lodge a complaint with the Information Regulator.

15. Keeping Your Information Accurate
We encourage candidates, clients and other users to keep the information they provide to NoSweat accurate and up to date.
If information about you is incorrect, incomplete or outdated, please contact us or update it through the relevant NoSweat account functionality where available.
16. Direct Marketing
NoSweat may communicate with candidates, clients and business contacts about opportunities, services or other relevant matters where permitted by law.
Electronic direct marketing is subject to section 69 of POPIA, and the Information Regulator has issued specific guidance on compliance with POPIA's direct-marketing requirements. (Empowered Compliance Monitoring)
